Litigation Of Counsel Drew Stevens will be co-presenting on AI and Nondiscrimination in a presentation titled, “Human Values for AI in Health Care,” at the American Health Law Association (“AHLA”) Complexities of AI in Healthcare Conference on May 17, 2024, in Chicago, IL.

The presentation will explore how hospitals and health systems can address the nondiscrimination compliance risks associated with the use of AI in healthcare and will discuss key topics including:

  • The increasingly prevalent use of AI in the healthcare industry;
  • The compliance risks presented by federal nondiscrimination law that hospitals and health systems must be aware of;
  • The Biden Administration’s revised regulation under Section 1557 of the Affordable Care Act which bars discrimination in the use of “patient care decision tools” and seeks to impose an ongoing duty on healthcare providers to identify and mitigate the risks of discrimination associated with the use of AI in clinical decision making;
  • The Biden Administration’s Executive Order on Safe and Secure AI as it relates to the use of AI in healthcare.

In his healthcare litigation practice, Drew regularly advises and represents health systems in connection with investigations and litigation related to compliance with federal nondiscrimination law, including in connection with investigations brought by the U.S. Department of Justice and the Office for Civil Rights within HHS.
