Overview

Tracy Field brings the experience of her work as a provider to her practice as a health industry attorney. With a background in clinical genetics and endocrinology, Tracy is conversant with the challenges and opportunities facing her clients. Her work is centered on advising healthcare and life sciences companies on the myriad regulatory and operational issues they face. Her background and knowledge of the industry enable her to provide strategic, actionable advice to her clients.

A former chief compliance officer for a large health system, Tracy is familiar with the regulatory and reimbursement challenges her clients face. She regularly advises healthcare providers on a wide range of compliance matters, including Medicare and Medicaid reimbursement issues, compliance issues, OIG and government investigations. In addition, Tracy has worked closely with clients regarding HIPAA and HiTech issues, including crisis management for potential breaches. Tracy also works with providers and life sciences clients on matters for clinical research trials, including dealing with conflict of interest issues.

Tracy is fiercely committed to ensuring that her clients get the best possible guidance in running their operations ethically, efficiently, and in compliance with the law. Her life sciences background and work as an industry executive offers her clients a unique and highly valuable perspective. Tracy is a frequent national presenter and thought leader on issues facing the healthcare industry.

Experience

  • Successfully represented providers in challenging reimbursement denials, including securing rulings that statistically extrapolated overpayment demands were invalid.
  • Successfully represented providers in enrollment revocation matters.
  • Advised providers on implementation of requirements under the No Surprises Act. 
  • Advised major health system in compliance investigation, including extensive review of reimbursement and potential False Claims Act issues, witness interviews, and review of complex business arrangements.
  • Represented providers (hospitals, physicians, home health agencies, hospice and skilled nursing facilities) in Medicare contractor audits and appeals for more than 20 years.
  • Advised providers regarding COVID-19 regulatory issues, including federal and state waivers, telehealth and reimbursement issues as well as CARES Act funding.
  • Advised multiple providers regarding regulatory matters, including compliance issues, investigations and voluntary refunds.
  • Successfully represented coalition of health care providers challenging multi-million dollar attempts by Medicare Administrative Contractor (MAC) to recoup alleged overpayments.  
  • Advise leading health information exchange regarding regulatory and operational issues, including HIPAA Privacy and Security compliance.
  • Successfully represented provider challenging Recovery Audit denials for outlier payments.

  • Successfully secured million-dollar reimbursements for providers for newly-approved drug.
  • Successfully overturned Medicaid reimbursement, resulting in a moratorium on reviews of inpatient admissions by the state recovery auditor.
  • Represented large healthcare system in arbitration of Medicare Advantage disputes as well as renegotiated participation contracts to include more favorable terms for the provider.
  • Advise clients regarding potential breaches, including analysis of reporting requirements.
  • Provide due diligence compliance and regulatory support to healthcare lending clients.
  • Counseled Business Associates and entities working with regulated providers on HIPAA Privacy, Transactions and Security Standards as well as HITECH implementation.
