Overview

Matt Roberts, an of counsel in the Bankruptcy practice group, represents creditors and debtors in bankruptcy matters, focusing on creditors’ rights in Chapters 7 and 11. Having spent time as an in-house attorney for a major payment processor, Matt has a unique understanding of the intersection between bankruptcy and merchant acquiring, as well as corporate clients’ needs more generally.

Matt has represented creditors in a variety of restructuring settings, including the purchase of assets out of bankruptcy, defense against claims of preference and fraudulent transfer, and general bankruptcy litigation. Matt’s experience also includes the representation of a merchant processor as a creditor in a Chapter 11 case.

Experience

  • Represented major payment processor in the negotiation of multiple multimillion-dollar merchant acquiring agreements.*
  • Achieved the dismissal of a lawsuit brought by a merchant-debtor seeking to enjoin its payment processor, acquiring bank, applicable card networks, and card issuers from processing certain chargebacks.*
  • Negotiated the assumption (under 11 U.S.C. § 365) of a payment processing client's card processing agreement with a merchant-debtor, resulting in the full repayment of a $600,000+ chargeback deficit.*
  • Litigated a substantial fraudulent transfer claim brought against a major airline.*
  • Negotiated and consensually resolved multiple preference claims brought against various clients, frequently at a substantial discount to the alleged value.
