The article reviews a significant enforcement action by the DOJ, which has intervened in a whistleblower lawsuit accusing major health insurers of paying illegal kickbacks to broker companies to steer seniors into certain Medicare Advantage plans and to exclude patients with disabilities from those plans. David noted that while CMS has long warned against excessive broker payments and health status-based compensation under the Anti-Kickback Statute, this case is the first to target large-scale, systemic efforts to steer patients into specific Medicare Advantage plans and exclude beneficiaries with disabilities.
