Litigation Of Counsel David Gallo will be co-presenting “Recent Cases Update” and speaking on the “Getting Started and Staying Active: Lessons from Providers and Practitioners” panel at the American Bar Association 2024 Arbitration Training Institute on June 6, 2024, in Atlanta, GA. He will also be part of the “Facilitated Sessions on the Award and Post-Award Issues” panel on June 7.

The “Recent Cases Update” discussion will review recent federal cases and address issues such as:

  • The enforcement of arbitration clauses by/against nonsignatories,
  • Whether the court or an arbitrator has the authority to decide the gateway issue of arbitrability,
  • Enforceability of awards,
  • The non-applicability of the FAA to certain disputes,
  • Obtaining documents and testimony from third parties, and
  • Vacatur of awards due to arbitrator misbehavior.

The “Getting Started and Staying Active: Lessons from Providers and Practitioners” panel of nationally recognized experts will review the arbitral process, including their viewpoints on:

  • Developing and maintaining a robust arbitration practice,
  • Selecting arbitrators,
  • Networking and social media and how it relates to the practice,
  • Qualities of an effective arbitrator from the perspective of arbitration institutions, and
  • Avoiding common mistakes.

The “Facilitated Sessions on the Award and Post-Award Issues” panel will provide guided conversation on issues raised in the preceding session on award and post-award issues, including an overview of the awards process and topics ranging from drafting to award confirmation/vacatur.
