Georgia Court Of Appeals Upholds CON For New Hospital -- Parker Hudson is pleased to announce that on March 23, 2010, the Georgia Court of Appeals issued a sound and well-reasoned decision further advancing Northeast Georgia Medical Center's long-running efforts to bring needed hospital and emergency services to the south Hall County area. Northeast Georgia, a community not-for-profit hospital with two hospital campuses in Gainesville, Georgia, has battled over three years, through several administrative and appellate proceedings, to obtain the necessary Certificate of Need approval to develop a new 100-bed hospital facility to serve the fast-growing communities in the southern portion of its service area. As established by the agency level evidentiary hearing, the new hospital facility will alleviate a significant unmet need in the relevant service area. Northeast Georgia's proposed project will be the first new hospital developed in Georgia in almost two decades.
Northeast Georgia's proposed South Hall Hospital has faced vigorous opposition from Winder HMA, Inc. d/b/a Barrow Regional Medical Center, located in Winder, Georgia. The Georgia Court of Appeals' decision, reported as Northeast Georgia Medical Center v. Winder HMA, Inc., Georgia Court of Appeals Case Nos. A09A2210, A09A2211 (March 23, 2010)(2010 Ga. App. LEXIS 291), held in Northeast Georgia's favor and affirmed the Georgia Department of Community Health's grant of a Certificate of Need to Northeast Georgia for the South Hall Hospital.
