About Anthony

Anthony is an associate with the firm's Commercial Finance practice group. He primarily represents banks and other financial institutions in asset-based commercial debt financing, including both revolving and term credit facilities. His representation frequently includes advising clients and structuring credit agreements to allow for the financing of inventory manufactured outside the United States during the time period in which the inventory is in-transit from the foreign location to the United States.

Anthony practiced previously in the Washington, D.C. office of Fried, Frank, Harris, Shriver & Jacobson, in the areas of commercial litigation and alternative dispute resolution. There, he represented clients on varied matters including the defense of corporate entities and their officers and directors in contact disputes, commercial tort claims, and breach of fiduciary duties actions. He also has arbitrated matters before the American Arbitration Association and represented software and manufacturing companies in trademark and copyright infringement actions.

Anthony brings significant business insight to his current practice. He is an experienced multi-unit franchise operator, having acquired and turned-around several underperforming quick service restaurant locations in the Atlanta metropolitan area before the successful sale of the locations in 2005. He is well-versed in the practical day-to-day issues facing small business and franchise owners.

Representative Engagements

  • Represented agent and lender in $80,000,000 revolving credit facility extended to distributor of heavy equipment manufactured by Asian affiliate, including the financing of inventory in-transit from Asia.
  • Acted as counsel to agent and lender in syndicated revolving credit facility to furniture importer and distributor regarding agent's security interest in inventory purchased from Asian manufacturers on open account and financed by lenders prior to the inventory's arrival in the United States.
  • Represented lender in $60,000,000 revolving credit facility to domestic manufacturer of special-purpose steel pipe, including the financing of inventory in-transit from both domestic and foreign steel suppliers
  • Acted as lender's counsel in revolving credit facility to seafood distributor, including the financing of inventory in-transit from South America.
  • Represented agent and lender in $138,000,000 revolving credit and term loan facility in connection with the "going private" of a healthcare linen service company. Representation included the negotiating and recording of mortgages and deeds of trust for 21 properties located in 12 jurisdictions.
  • Represented agent and lender in $32,500,000 revolving credit facility to manufacturer of special purpose carbon and alloy wire used in the transportation and construction industries.
  • Represented agent and lender in $71,000,000 revolving credit and term loan facility to a building supply and services company and its real estate affiliate.
  • Acted as counsel to lender in revolving credit facility extended to regional supermarket chain.
  • Acted as lender's counsel in revolving credit and term loan facility to manufacturer of air powered chain hoists and other lifting equipment, which financing helped fund the acquisition of a new affiliate that produced related industrial equipment and hardware.
  • Acted as counsel to agent and lender in $950,000,000 revolving credit and term loan facilities to distributor of modular building units and its real estate affiliate to facilitate borrowers' purchase of its major competitor. Representation included the negotiating and recording of mortgages and deeds of trust for 23 properties located in 19 jurisdictions.
  • Acted as counsel to lender in $55,000,000 revolving credit loan facility to distributor of stationery, scrapbook and other paper products, the proceeds of which helped finance the purchase of assets from the bankruptcy estate of an insolvent picture frame manufacturer.
